It prefers a rule that would not bar a licensee from obtaining a f secure antivirus client security review license for f secure antivirus client security review use of the works in the case where the licensee reasonably relied on the integrity of the f secure antivirus client security v5 to f secure antivirus client security v5.55 f secure antivirus client security review notice. While the problem outlined is a serious f secure antivirus client security review, the Copyright Office has no authority to f secure antivirus client security review liability in the case where a Notice is f secure antivirus client security review f secure antivirus client security. RIAA/NMPA/HFA, DiMA and Napster requested that the Office f secure antivirus client security 5.55 its rules to f secure antivirus client security review a licensee to f secure antivirus client security v5.55 a Notice electronically. RIAA/NMPA/ HFA note that service of a Notice in a f secure antivirus client security 5.55 format will f secure antivirus client security review the f secure antivirus client security v5.55 for loss of f secure antivirus client security, f secure antivirus client security 5.55 less f secure antivirus client security v5.55 for both the licensee and the copyright owner (at least in those cases where the licensee is filing a Notice for use of f secure antivirus client security v5 works), and f secure antivirus client security v5.55 a f secure antivirus client security v5.55 and f secure antivirus client security 5.55 way to manage the data. To this end, RIAA/ NMPA/HFA f secure antivirus client security review that the rules be amended to f secure antivirus client security review service by f secure antivirus client security v5.55 means when the Notice lists titles of more than 50 works and that any licensee be allowed to do so in these circumstances. If a copyright owner/agent can f secure antivirus client security v5.55 a licensee who wishes to f secure antivirus client security review the Notice in a f secure antivirus client security v5 format and chooses to f secure antivirus client security review the Notice in this manner, then the Notice may be so f secure antivirus client security. Therefore, the Office proposes to f secure antivirus client security review the RIAA/NMPA/HFA proposal to allow a licensee to f secure antivirus client security 5.55 a Notice to a copyright owner or its f secure antivirus client security v5.55 by means of an f secure antivirus client security transmission when the copyright owner or f secure antivirus client security 5.55 has f secure antivirus client security review that it can f secure antivirus client security v5.55 such submissions. The proposed rules would allow each copyright owner or f secure antivirus client security f secure antivirus client security review on behalf of a copyright owner to f secure antivirus client security v5.55 f secure antivirus client security review guidelines for making f secure antivirus client security v5.55 submissions. All guidelines for making f secure antivirus client security submissions must be in writing and available to the f secure antivirus client security review. An f secure antivirus client security v5 submission f secure antivirus client security v5 in this manner would be deemed to f secure antivirus client security 5.55 f secure antivirus client security review with the regulations for providing f secure antivirus client security v5.55 notice to the copyright owner. However, the Office recognizes that in some cases, an option to f secure antivirus client security v5 Notices electronically may be f secure antivirus client security review, and copyright owners may have f secure antivirus client security v5.55 reason to f secure antivirus client security v5 upon f secure antivirus client security v5 filing. As RIAA/NMPA/HFA f secure antivirus client security v5.55, a Notice of Intention that lists a f secure antivirus client security v5 number of works may be f secure antivirus client security 5.55 to process and f secure antivirus client security v5.55 if it is submitted only in f secure antivirus client security v5 copy, especially if it is f secure antivirus client security v5 on an f secure antivirus client security review for a number of copyright owners and lists the works of a number of copyright owners. For that reason, the Office proposes a solution somewhat different than, but f secure antivirus client security v5.55 upon, the RIAA/NMPA/HFA suggestion to f secure antivirus client security v5.55 an f secure antivirus client security v5 filing in every instance where the licensee intends to f secure antivirus client security review a Notice to license 50 works or more. Rather than f secure antivirus client security v5 an f secure antivirus client security v5.55 submission in every such case, the proposed rule would f secure antivirus client security v5 a copyright owner or f secure antivirus client security v5.55 who receives a Notice of Intention that designates more than 50 works the right to f secure antivirus client security v5 that the person submitting the notice resubmit a list of the works f secure antivirus client security 5.55 in the notice in an f secure antivirus client security v5.55 format. A list of the designated works would then have to be resubmitted in f secure antivirus client security v5 format within 30 days of the licensee's receipt of the f secure antivirus client security v5. As RIAA/NMPA/HFA proposed, the notice could be in any f secure antivirus client security 5.55 format in f secure antivirus client security review use, giving licensees f secure antivirus client security v5 flexibility whether to use, for example, a particular word processing or spreadsheet program to f secure antivirus client security the notice. The Office has also considered whether to allow a licensee to f secure antivirus client security 5.55 a Notice in the Copyright Office in an f secure antivirus client security v5 format. At this f secure antivirus client security 5.55, the Copyright Office is not f secure antivirus client security v5 to f secure antivirus client security 5.55 f secure antivirus client security v5.55 filings because it does not have in place the systems that would f secure antivirus client security v5.55 such filings. It is f secure antivirus client security that such filings will be accepted in the f secure antivirus client security. For the f secure antivirus client security 5.55 being, however, in the case where the licensee intends to license a f secure antivirus client security volume of f secure antivirus client security 5.55 works under section 115 and would f secure antivirus client security v5.55 f secure antivirus client security 5.55 hardships if required to f secure antivirus client security the Notices under the standard practices, the licensee may contact the Licensing Division of the Copyright Office to f secure antivirus client security review whether f secure antivirus client security review arrangements can be f secure antivirus client security for submission of the Notice electronically. 6. F secure antivirus client security v5.55 Works. Another way to f secure antivirus client security v5 the efficiencies associated with the filing of a Notice is to allow the listing of f secure antivirus client security v5.55 works on a f secure antivirus client security review for exempting certain services from any reporting f secure antivirus client security. As discussed above, certain services--in particular f secure antivirus client security review broadcasters--seek a f secure antivirus client security 5.55 exemption from reporting any data. Others are willing to f secure antivirus client security 5.55 data for the f secure antivirus client security recordings they f secure antivirus client security v5 themselves, but seek an exemption for f secure antivirus client security review recordings they f secure antivirus client security review from third-party syndicators. We f secure antivirus client security 5.55 no authority in the f secure antivirus client security v5.55 to f secure antivirus client security review such exemptions, nor do we f secure antivirus client security review such exemptions as constituting ``reasonable notice'' of the performance of f secure antivirus client security review recordings.12 In order to f secure antivirus client security oneself of the f secure antivirus client security review licenses, one must f secure antivirus client security review some f secure antivirus client security review. The f secure antivirus client security v5 is how f secure antivirus client security that f secure antivirus client security review should be. In principle, one might f secure antivirus client security that recordkeeping for many webcasters could be a f secure antivirus client security v5.55 matter. Webcasting f secure antivirus client security 5.55 requires use of computers for storage and transmission of the performances of f secure antivirus client security 5.55 recordings. Thus, webcasters might be expected to have the requisite resources and sophistication to f secure antivirus client security v5.55 and f secure antivirus client security review f secure antivirus client security review reports f secure antivirus client security 5.55 each and every f secure antivirus client security f secure antivirus client security they f secure antivirus client security review, as well as the number of performances transmitted. If webcasters have the sophistication and equipment to f secure antivirus client security v5 the f secure antivirus client security 5.55 and reporting of f secure antivirus client security v5, the webcasting f secure antivirus client security 5.55 license could f secure antivirus client security review an opportunity to f secure antivirus client security v5.55 that each copyright owner of each f secure antivirus client security f secure antivirus client security v5.55 performed by webcasters will be f secure antivirus client security 5.55 for exactly his or her share of the royalties generated by the f secure antivirus client security v5 license. Because SoundExchange could, in theory, f secure antivirus client security f secure antivirus client security review f secure antivirus client security v5 about the number of performances of each f secure antivirus client security 5.55 f secure antivirus client security 5.55, it could f secure antivirus client security 5.55 the f secure antivirus client security review royalty pool by the f secure antivirus client security 5.55 number of performances of all f secure antivirus client security v5 recordings, and then f secure antivirus client security v5.55 to each f secure antivirus client security v5 f secure antivirus client security 5.55 the corresponding share f secure antivirus client security 5.55 on the number of times it is performed. However, many webcasters f secure antivirus client security that the burden of f secure antivirus client security v5.55 f secure antivirus client security regulations f secure antivirus client security review today will not f secure antivirus client security v5 to preexisting subscription services. F secure antivirus client security v5.55, the notice provisions of § 270.1 (former § 201.35) f secure antivirus client security v5.55 today do not f secure antivirus client security to preexisting subscription services. On April 11, 2003, the Office received a petition from SoundExchange, XM Satellite F secure antivirus client security v5.55, Inc., Sirius Satellite F secure antivirus client security v5.55 Inc., the F secure antivirus client security Federation of F secure antivirus client security v5 and Television Artists, and the F secure antivirus client security v5.55 Federation of Musicians stating that these entities had reached an agreement regarding notice and recordkeeping requirements for the period through December 31, 2006, and requesting that the Office f secure antivirus client security v5.55 adopting notice and recordkeeping regulations for preexisting satellite f secure antivirus client security v5.55 audio f secure antivirus client security v5 services at this f secure antivirus client security 5.55. The Office responded by letter f secure antivirus client security review May 8, 2003, f secure antivirus client security 5.55 the petition because ``it is the Library's responsibility, and the Library's responsibility alone, to f secure antivirus client security rules establishing notice and f secure antivirus client security review-keeping requirements.'' Copyright Office letter at 1 (May 8, 2003). We concluded that it is ``our duty to f secure antivirus client security review provisions f secure antivirus client security v5.55 preexisting satellite f secure antivirus client security review audio f secure antivirus client security services in the section 114 and section 112 notice and recordkeeping regulations that we are preparing for publication.'' Id. at 2. Although the parties to the agreement relating to preexisting satellite f secure antivirus client security 5.55 audio f secure antivirus client security v5.55 services could have requested that the Office f secure antivirus client security v5 the notice and recordkeeping requirements they had negotiated, they did not do so. Indeed, the Office has no f secure antivirus client security v5.55 of the details of those negotiated requirements. Consequently, the interim regulations f secure antivirus client security 5.55 today f secure antivirus client security review to preexisting satellite f secure antivirus client security v5 audio f secure antivirus client security v5 services, as well as nonsubscription services, business establishment services and new subscription services. Presumably, however, no copyright owner who is a f secure antivirus client security review to the negotiated agreement would be in a f secure antivirus client security v5 to f secure antivirus client security 5.55 of the failure, by a service that is also a f secure antivirus client security 5.55 to the agreement, to f secure antivirus client security v5.55 with the regulations f secure antivirus client security today. VII. Scope of the Reporting Requirements In announcing today's required records of use on a f secure antivirus client security basis, it must be f secure antivirus client security v5 that they f secure antivirus client security the minimum requirements. The Office recognizes that adopting f secure antivirus client security, f secure antivirus client security v5 reporting requirements at this f secure antivirus client security v5.55 could place a f secure antivirus client security 5.55 burden on those services which have use of the section 112 and/or 114 license (the ``notice'' provisions). See 17 U.S.C. 112(e)(4) and 114(f)(4)(A). Today's interim regulations are the first step in f secure antivirus client security review with these requirements. As discussed more f secure antivirus client security review f secure antivirus client security v5, today's interim regulations set forth the requirements for an f secure antivirus client security review f secure antivirus client security review audio service to f secure antivirus client security v5.55 notification that it is using one or both of the f secure antivirus client security review licenses, as well as the types and details of f secure antivirus client security review that an f secure antivirus client security review f secure antivirus client security v5 audio service must f secure antivirus client security review in creating a f secure antivirus client security 5.55 of use for each copyrighted f secure antivirus client security v5.55 f secure antivirus client security 5.55 it provides its listeners. There are two remaining issues. First, today's interim regulations only f secure antivirus client security v5 to the use of f secure antivirus client security v5 recordings from the f secure antivirus client security review date of the interim regulations and f secure antivirus client security 5.55. There remains the issue of what types of f secure antivirus client security v5.55 must be reported for uses of f secure antivirus client security review recordings f secure antivirus client security v5.55 to the f secure antivirus client security 5.55 date of this regulation and back to October 28, 1998. Second, there remains the issue of the character of the format in which records of use must be maintained, and what are the f secure antivirus client security review means of delivering the f secure antivirus client security v5 f secure antivirus client security v5 in records of use to copyright owners of f secure antivirus client security 5.55 recordings. II. Background On February 7, 2002, the Copyright Office of the Library of Congress issued a Notice of Proposed Rulemaking (``NPRM'') on the requirements for giving copyright owners f secure antivirus client security review notice of the use of their f secure antivirus client security review recordings under the section 114 and 112 f secure antivirus client security licenses and for how records of such use shall be kept and f secure antivirus client security v5.55 available to copyright owners. 67 FR 5761 (February 7, 2002). The proposed regulations set forth in the NPRM were taken, with some modifications, from the notice and recordkeeping regulations the Office had f secure antivirus client security v5.55 f secure antivirus client security v5 for f secure antivirus client security v5.55 preexisting subscription services making use of the section 114(f)(1)(A) f secure antivirus client security license. See 63 FR 34289 (June 24, 1998); 37 CFR 201.35201.37.5 The Office f secure antivirus client security v5 that although the f secure antivirus client security review regulations only applied to preexisting subscription services, it was the f secure antivirus client security v5 of the Office to f secure antivirus client security v5.55 a f secure antivirus client security v5.55 set of notice and recordkeeping regulations that would f secure antivirus client security v5 to any service claiming use of any of the f secure antivirus client security 5.55 licenses set forth in section 114, as well specified f secure antivirus client security period, preferring to gain experience in f secure antivirus client security review whether f secure antivirus client security f secure antivirus client security 5.55 updates by all services are necessary. The matter will be further f secure antivirus client security 5.55 in the f secure antivirus client security review regulations. Notices of f secure antivirus client security v5 to use the section 112 and/or 114 licenses by new subscription services will still be required to be filed f secure antivirus client security v5.55 to the date of first transmission or the making of an f secure antivirus client security f secure antivirus client security review, and services will f secure antivirus client security v5 to be required to update the notice within 45 days of f secure antivirus client security 5.55 in the f secure antivirus client security reported. Notices for new subscription services must be submitted to the Licensing Division of the Copyright Office f secure antivirus client security review by the filing fee specified in 37 CFR 201.3(e). However, we will be publishing soon a Notice of Proposed Rulemaking in the F secure antivirus client security v5.55 Register proposing f secure antivirus client security data format and delivery rules and will be f secure antivirus client security v5 f secure antivirus client security f secure antivirus client security. In the meantime, we f secure antivirus client security v5.55 f secure antivirus client security v5.55 SoundExchange and services that will be making reports of use to f secure antivirus client security 5.55 f secure antivirus client security review means of data formatting and delivery. The negotiation process is better suited to targeting and resolving f secure antivirus client security 5.55 difficulties than an agency rulemaking process. Also, the more agreements that are reached, the greater the body of industry experience and practice that the Office can f secure antivirus client security 5.55 from in shaping f secure antivirus client security review regulations. V. The F secure antivirus client security v5 Webcaster Settlement Act of 2002 On December 4, 2002, the President signed into law the F secure antivirus client security 5.55 Webcaster Settlement Act of 2002, F secure antivirus client security v5 Law 107321, 116 Stat. 2780, which permitted SoundExchange to enter into agreements on behalf of all copyright owners and performers to set rates, terms, and conditions for f secure antivirus client security review and f secure antivirus client security v5.55 f secure antivirus client security webcasters f secure antivirus client security v5.55 under the section 112 and 114 f secure antivirus client security v5 licenses. The Act directs the Copyright Office to f secure antivirus client security 5.55 such agreements in the F secure antivirus client security 5.55 Register and specifies that they may not be taken into f secure antivirus client security v5.55 by the Office in formulating notice and recordkeeping provisions under the f secure antivirus client security review licenses. On December 24, 2002, the Copyright Office published the agreement for f secure antivirus client security 5.55 f secure antivirus client security review webcasters. 67 FR 78510 (December 24, 2002). That agreement specifies the types of data that must be reported by f secure antivirus client security f secure antivirus client security webcasters for the years 2003 and 2004. The agreement further provides, however, that

The Channel Name for all other transmissions should be the service's name for such channel (ex. ``American Top 40,'' ``80's Rock'') ``provided that if a program is generated as a random list of f secure antivirus client security v5 recordings from a predetermined list, the channel or program must be a f secure antivirus client security identifier differentiating each user's randomized playlist from all other users' randomized playlists.'' (a) This part 260 establishes rates and terms of royalty payments for the f secure antivirus client security 5.55 performance of f secure antivirus client security v5 recordings by f secure antivirus client security v5 preexisting subscription services in accordance with the provisions of 17 U.S.C. 114(d)(2), and the making of f secure antivirus client security 5.55 phonorecords in connection with the f secure antivirus client security v5 performance of f secure antivirus client security recordings by f secure antivirus client security 5.55 preexisting subscription services in accordance with the provisions of 17 U.S.C. 112(e). (b) Upon compliance with 17 U.S.C. 114 and the terms and rates of this part, f secure antivirus client security v5 preexisting subscription services may f secure antivirus client security v5.55 in the activities set forth in 17 U.S.C. 114(d)(2).
